COVENANT REGARDING REAL PROPERTY
Becki L. DeBont and HeatherD Smith ("OWNERS" hereinafter), are the owners of real
property commonly known. as Assessor's Parcel Number 314-214-14 ("PROPERTY
hereinafter), and more fully described as:
Lots 24, 25 and 26, Block 15 of Piermont, in the City of Poway, County of San Diego,
State of California, according to Map thereof No. 785, filed in the Office of the County Recorder
of San Diego County, May 27,1887
In consideration of the approval of a Building Permit to construct a 382-square-foot,
detached guest house on the referenced property by tile City of poway ("CITY" .hereinafter),
OWNER hereby agrees that the detached guest house' shall never be rented or leased as a

ampere electrical service shall ever be installed, except in the"water heater area and then used
solely for water heater purposes.
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrance's, successors, heirs, personal representatives, transferees and
assigns of the respective parties.
In the event that a Building perrnjtis never obtained to construct the proposed detached
guest house at the request of the OWNER, the CITY shall expunge this Covenant from the
record title of the PROPERTY
If either party is required to incur costs to enforce the provisions of this CovelJant, the
prevaililJg party' shall be eIJtitled to full reimbursement of all costs, including reasonable
attorneys' fees,. from the oth,er party The CITY fllay assign to persons impacted by the -
performance of this CovenantJheright to enforce this Covenant agaiIJst the OWNERS.
