"GRANTEE"), its successors, or assigns express permission -10 construct a concrete masonry
sound wall along the westerly edge of'the subjecl.proPElrtY.line, at or along the alignment of the
existing chain ,link fence, as well as, the Temporary' ConstruCtion Easement and incidents
thereto for construction of asouhd wall across that certain real property in the City of Poway,
County of San Diego, State orCalifornia,
From'the Westerly Property Line to the Easterly Top of the Drainage Culvert
The GRANTOR, hereby furth.Elr gr.ants to, the City ,of Poway ,the privilege and right to extend
excclYation and embankmenf slopes within the limits of the herein described Tempgrary
Construction Easement, where required for the construction and maintenance of said sound,
wall.
The GRANTOR, for him/herself, his/her successors and assigns, hereby waives Clny claim for
any and ail severance' damages to GRANTOR~s remaiDing property contiguous to the
Temporary Construction Easement 'hereby conveyed by reas'On of the location, construction,
landscaping, or maintenance of said' easement.
The' GRANTOR hereby further grants to GRANTEE the right to temporarily enter and construct
necessary reiated improvemehtsas paJ;lofthe propolieg cons.lruction process. This Temporary
Constructipl1 Easef!1ent, . as described; shall be valid only. until the construction has been
<Ojccepted by the GRANTEE. After'such time, the Temporary Construction' Easement shall
become null and void.
