COVENANT REGARDING REALPROPERTY
Pennie. Zawacki, As TriJstee of the Pennie L Zawacki Revocable Living Trust,
PROPERTY OWNER ("OWNER" hereinafter), is,the'owner of real property described in
Exhibit A, which is attached hereto and made a part hereof: and which is commonly
known as Assessor's Parcel f~umber 323-071-04 ("PROPERTY" hereinafter). In
consideration of theapprov~l,of a Building Permit toconstrucf a 4,443-square-foot
single-family residence having an attached second story guest house 01'1 the referenced
property by the City of Poway ("CITY"hereinaffer), OWNER hereby agrees that no part
of the second storY guest house.shall ever be rented or leased as a separate unit and

complete kitchen facilities shall never be installed.
This Covenant shall run with the land and be binding upon and inure to the
benefit of the future owners, encumbrances, successors, heirs, personal
representatives, tranSferees and assigns of the respective.parties.
In the event of litigation to enforce the provisions of this Covenant, the prevailing
party shall be entitled to full mimbursement of all costs, including reasonable attorneys'
fees, from the other party
