AN ORDINANCE OF ~ CITY OF POWAY, CALIFO~IA
AMI~IDING SECTION 35. 404 OF THE
(]ODE OF t~GULATORY ORDINANCES
THE CITY GDUNCIL OF THE CITY OF POWAY DOES ORDAIN AS FOLTOWS:
Section 1. Section 35.404 is hereby amended to r~ad:
Section 35.404 Notice to clean premises.
If it is determined that a public nuisance, as herein defined, exists on
any lot or prenise, or upon any sidewalk, parking lot or street adjacent to
such lot or pr~nise, the Director of Safety Services shall cause a notice to
be issued to abate such nuisance. Such notice shall be headed: "NOTICE TO
c~.P3kN PP4~4ISES" in letters not less than one inch (1") in height and which
shall, in legible characters, direct the abatement of the nuisance and refer
to this article and section for particulars. Notices served by m~ns of
other than posting as provided by this article shall contain a description
of the property in general terms r~.~onably sufficient to identify the loca-
tion of the nuisance.
If notice herein described, in addition to orders relative to other waste
material, shall require lots of t~o (2) gross acres or less to be cl~red in
accordance with Section 35.401 or as otherwise directed by the Director of
Safety Services, and lots of t~o (2) acres or more to have maintained at
least a thirty (30) foot fire break. Fire breaks of up to 100 f~. may be
required at the discretion of the Director of Safety Services when
topographical and vegetative conditions warrant.
Section 2.
This ordinance shall take effect and be in force thirty (30) days after the date
of its passage; and before the expiration of fift~n (15) days after its
passage, it shall be published once with the names and menbers ~ting for and
against the same in the Poway News Chieftain, a newspaper of general circulation
published in the City of Poway.
Introduced and first read at a regular meeting of the City Council of the
City of Poway held the 19th day of April, 1983, and thereafter PASSfD AND
ADOPTED at a regular meeting of said City Council held the 26th day of April,
1983, by the following roll call ~te:
