COVENANT REGARDING REAL PROPERTY
Wanda Eng, a ~widow, ("OWNER" hereinafter), is the owner of real property commonly

known as Assessor's Parcel Number 322-041-39 ("PROPERTY hereinafter), and more fully'
described as:
Parcel 2 of Parcel Map ,No. 10213, in the County of ~an Diego, State of Ca,lifo[nia, said
map being filed in the office of the county recorder of San Diego County, July 10, 1980, as File
No. 80-217151 of OfficialRecords,
In consideration of the approval of a Buiiding Permit to construct a 440-square-fciot,
detached guest house on the referenced property by the City of poway ("CITY" hereinafter),
OWNER hereby agrees that the detached guest house 'shall never be rented or ieased as a
separate unit, no complete kitchen facilities shall be installed, and no gas line and/or 220

ampere electrical service shall ever be installed, except in the-water heater area and then used
solelyfcir water heater purposes.
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrances, successors, heirs, personal representatives, transferees and
assigns of the respective parties,
In'the event that a Building Perlllit is never obtained to construct the proposed detached
guest house at the request of the OWNER, the CITY shall expunge this Covenant from the
record title of the PROPERTY

If either party is required to incur tosts to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including reasonable
attorneys' fees, from the other party The CITY may assign to persons impacted by the
performance of this Covenant the right to enforce this Covenant against the OWNER.
