Whereas Nathan C and Rachel L. Cannon, PROPERTY'OWNERS ("OWNER" hereinafter) are
the owners of real, property commonly known as 11545 Creek.Road ("PROPERTY" hereinafter), and
more fully described in Exhibit A.
In consideration,of the approval by the City of Poway ("CITY" hereinafter) of Minor Development
Review Application 04-07, involving the construction of a singlecfam,jly home and a 2,400-square-foot
detached garage, OWNER hereby agrees that no commerciaL activities shall occur within the detached
garage, except as defined in the Poway'Municipal Code, Sectibtl 17.28, Home Occupations.
This Covenant shall run with thela'ndand be binding upon and inure to the benefit of the future
'owners, encumbrancers, successors,heirs, 'personal representatives, transferees and assigns of the
respective parties.
In the event of litigation to enforcethe.provisions of this Covenant, the prevailing party shall be
entitled to full reirnbursement of all costs, including reasonable attorneys' fees, from the other party
