COVENANT REGARDING REAL PROPERTY
(No Documentary Transfer Tax Due)
Jonathan Weisz and Kimberly Weisz, PROPERTY OWNERS ("OWNERS" hereinafter), are
the owners of real property described as:
PARCELS 3 AND 4 OF MAP NO 14319 IN THE CITY OF POWAY, COUNTY OF SAN
DIEGO, STATE OF CALIFORNIA, AS RECORDED IN THE OFFICE OF THE COUNTY
RECORDER FILED ON JUNE 18, 1986, UNDER INSTRUMENT NUMBER 86-245870
In consideration of the approval of Minor Development Review (MDRA) 03-62R(2), by the City of
Poway ("CITY" hereinafter), OWNERS hereby acknowledge that the private recreation facility, as
described in-the approvalletter-for.MElRA 03-62R(2) and shown on the approved-site plan-on filewith--' - - -
the City of Poway, Parcel 4 is an accessory use to the residence on Parcel 3 and that the recreation
facility shall not be used for any purpose other than that normally associated with a residential use It
is further acknowledged that Parcel 3, and Parcel 4 shall remain under the same ownership (i.e., not
separately owned) unless the recreation facility use has been discontinued and the improvements
removed to the satisfaction of the Director of Development Services, or an MDRA and residential
Building Permit has been issued for the recreation facility site (Parcel 4)
This Covenant shall run with the land and be binding upon and inure to the benefit of the future
owners, encumbrancers, successors, heirs, personal representatives, transferees and assigns of the
respective parties.
Inthe event"of litigation to enforce the provisions of this Covenant, the prevailing party shall be
entitled to full reimbursement of all costs, including reasonable attorneys' es, from the other party
