owners of real property commonly known as 13021 Solera Way ("PROPERTY" hereinafter) and
more fully described as:
Lot 269 of Panorama Hills Unit No 2, in the City of Poway, County of San Diego, State of
California, according to map thereof No 8457, filed in the Office of the' County Recorder of
San Diego County on January 1..1, 1977
In consideration of City of Pbway ("CITY" hereinafter) approval of a Buildi(1g Permit to
cOllstruct a 660~square~foot, detached guesUpool house, with a 486-square-foot patio area at an
existing single-family residence located at 13021 Solera Way:, in the Rural-Residential A (RR-A)
zone, OWNER hereby .ag~ees that' QO. p_()raior:l'of' the~;guesUpool'houseoshall"ever be-rented, or
leased.as a separate unit and kitchen facilities shall never be installed. No natural gas connection-
or 220V electricity is permitted in the kitchen/wet bar area.
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrancers, successors, heirs, per?onal representatives, transferees and
assigns of the respective parties.
In the event that building permit expires or is rescinded by City Council at the request ofthe
OWNER, CITY shall expunge this Covenant from the record title of the PROPERTY
In the event of litigation to enforce the provisions of this Covenant, the prevailing party shall
be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the other
