COVENANT REGARDING REAL PROPERTY
Raymond Reza Siry, a single man ("OWNER" hereinafter), is the owner of real property
which is commonly known as 12212 Old Stone Road ("PROPERTY" hereinafter), and more fully
described as:
PARCEL 3 OF PARCEL MAP NO 9035, IN THE CITY OF POWAY, COUNTY OF
SAN DIEGO, STATE OF CALIFORNIA, FILED IN THE OFFICE OF THE COUNTY
RECORDER OF SAN DIEGO COUNTY, AUGUST 9,1979
In consideration of the approval of a Building Permit to construct a 1,338-square-foot, barn
with a loft at the above-referenced property by the City of Poway ("CITY" hereinafter), OWNER
hereby agrees that the barn shall never be converted to living space without first obtaining
approval and appropriate permits from CITY
This Covenant shall-run witli 'the 'lanaand-be 'binding upon- and inure to thebenefiteWtlie
future owners, encumbrance's, successors, heirs, personal representatives, transferees and
assigns of the respective parties.
In the event that a Building Permit is never obtained to construct the proposed detached
structure, at the request of the OWNER, the CITY shall expunge this Covenant from the record title
of the PROPERTY
If either party is required to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including reasonable attorneys'
fees, from the other party The CITY may assign to personsi pacted by the performa of this
Covenant the right to enforce this Covenant against the 0 R
