- - COVENANT REGARDiNG REAt PROPERTY
Michael L. Kropf and Suzanne M. Kropf, Trustees of the Kropf Family Trust dated
November 13, 2001 ("OWNER" hereinafter), are the owners of real property which is commonly
known as 16275 Wind piper Road ("PROPERTY" hereinafter), and more fully described as:
LOT 76 OF THE CITY OF POWAY TRACT NO 4090-R, IN THE CITY OF POWAY,
COUNTY OF SAN DIEGO, STATE OF CAliFORNIA, ACCORDING TO MAP
THEREOF NO 11360, FILED IN THE OFFICE OF THE COUNTY RECORDER OF
SAN DIEGO COUNTY, ON OCTOBER 24,1985.
In consideration of the approval of a Building Permit to construct a 540-square-foot,
detached accessory structure at the above-referenced property by the City of poway ("CITY"
hereinaft,er), OWNER hereby agrees that the detached structure shall never be converted to living
space without first obtaining approval and appropriate perrnits from CITY --
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrance's, successors, heirs, personal representatives, transferees and
assigns ofthe respective parties.
In the event that a Building Permit is never obtained to construct the proposed detached
stcucture, at the request of the OWNER, the CITY shall expunge this Covenant frorn the record title
ofthe PROPERTY
If either party is required to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including reasonable attorneys'
fees, from the other party The CITY may assign to persons impacted by the performance of this
Covenant the right to enforce this Covenant against the OWNER.
