COVENANT REGARDING REAL PROPERTY

Thomas W Crosby, Sr and Sandra J. Crosby, Husband and Wife as Joint Tenants
("OWNER" hereinafter), are the owners cif real property commonly known 13509 Powers Road
("PROPERTY' hereinafter), and more fully described as:
LOT 39 OF POWAY VALLEY HOMES, IN THE CITY OF POWAY, COUNTY OF
SAN DIEGO, STATE OF CAliFORNIA, ACCORDING TO MAP THEREOF NO
3855, FILED IN THE OFFICE OF THE COUNTY RECORDER OF SAN DIEGO
COUNTY, APRIL 2,1958.
In consideration of the approval of a Building Permit to construct a 496-square-foot
storage room on the referenced property by the City of poway ("CITY" hereinafter), OWNER
hereby agrees that the storage,rqpm shall not be converted to living space without first obtaining
approval and applicable permits frorriCITY

This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners. encumbrance's, successors, heirs. personal representatives, transferees and
assigns of the respective parties.
In the event that a Building Permit is never obtained to construct the proposed storage
roorin at the request of the OWNER, the CITY shall expunge this Covenant from the record title
of the PROPERTY
If either party is required to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including reasonable
attorneys' fees, from the other party The CITY may assign to persons impacted by the
performance of this Covenant the right to enforce this Covenant against the OWN
