CC 1998 01-27 CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING JANUARY 27, 1998 The January 27, 1998, regular meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Mayor Higginson at the City Council Chambers, 13325 Civic Center Drive, Poway, California. PRESENTATION Ken Steele, Engineer with the San Diego County Water Authority, reported on the status of the Emergency Storage Project and the funding plan. The SDCWA anticipates adopting the revised revenue structure in March after extensive public outreach. 6278 Page 2 - CITY OF POWAY - January 27, 1998 PUBLIC ORAL COMMUNICATIONS Mayor Higginson explained the procedure for Public Oral Communications. Thera was no one present wishing to speak. CONSENT CALENDAR Motion by Councilmember Goldby, seconded by Councilmember Rexford to approve the Consent Calendar, as follows: 3. Ratification of Warrant Register for period of January 5-9, 1998. (401-10) 4. Confirmation of appointment of Frank Goldsmith as chairperson to the Performing Arts Advisory Committee. (701-09) Motion carried 4-0 with Councilmember Cafagna absent. ITEM 1 (203-08) CONDITIONAL USE PERMIT 96-15M(2) APPLICANT: PERRY FALK Mayor Higginson opened the public hearing. Staff report by City Manager Bowersox. This is a request to store 126 - 200 new vehicles at the City's Materials Handling Yard at 12325 Crosthwaite Circle. A new car vehicle storage area was considered in the site design during the planning stages for this facility. Staff recommends approval. There was no one present wishing to speak. Motion by Councilmember Emery, seconded by Councilmember Goldby to close the public hearing and adopt Planning Resolution No. P-98-07, entitled, "A Resolution of the City Council of the City of Poway, California Approving a Modification to Conditional Use Permit 95-15M(2), Assessor's Parcel Number 317-280-50." Motion carried 4-0 with Councilmember Cafagna absent. (Richard Ludwig turned in a speaker's slip as the vote was being taken. Mayor Higginson did not allow him to speak.) ITEM 2 (209-00) REGIONAL CLUSTER BASED ECONOMIC DEVELOPMENT INITIATIVE 6279 Page 3 - CITY OF POWAY - January 27, 1998 Staff report by City Manager Bowersox. The San Diego Regional Economic Development Corporation is promoting the creation of a regional cluster-based initiative designed to bring the region's high technology industry leadership, local government, educational institutions, and military together to collaborate for economic prosperity. The principal goal is to improve the standard of living through the creation of new high paying jobs and to increase per capita income. Motion by Councilmember Rexford, seconded by Councilmember Emery to adopt Resolution No. 98-004, entitled, "A Resolution of the City Council of the City of Poway Finding Support for Creation of Partnership for the New Century Economy - A Regional Cluster Based Economic Development Initiative." Motion carried 4-0 with Councilmember Cafagna absent. ITEM 2.1 (1170-04) SOLID WASTE TRANSFER STATION Staff report by City Manager Bowersox. In September, 1997, the City of Poway joined with Del Mar, Encinitas, National City, Solana Beach, and Vista to form the Regional Solid Waste Association. One of the options being considered is the construction of a solid waste transfer station within the City of Vista. To date, all costs have been paid on a proportional basis. Should the Association proceed with the issuance of debt to finance the construction of a transfer station, all costs can be reimbursed to member cities from a portion of the proceeds. Legal counsel has determined that the appropriate mechanism to permit reimbursement would be though the adoption of inducement resolutions by the Association and each member agency. City Manger Bowersox noted that the staff report should read, "The approval of the inducement resolution does not obligate the Association to issue debt...." Motion by Councilmember Emery, seconded by Councilmember Goldby to adopt Resolution No. 98-005, entitled, "Resolution of the City Council of the City of Poway, California, Regarding its Intention to Issue Tax-exempt Obligations." Motion carried 4-0 with Councilmember Cafagna absent. CITY ATTORNEY ITEMS City Attorney Eckis requested a closed session for pending litigation pursuant to Government Code Section 54956.9(a), case of Peter B. Bybee v. the City of Poway and Trident Homes. 6280 Page 4 - CITY OF POWAY - January 27, 1998 CLOSED SESSION Mayor Higginson adjourned the meeting into closed session at 7:45 p.m. CALL TO ORDER AND ADJOURNMENT Mayor Higginson called the meeting back to order at 8:10 p.m. Upon motion by Councilmember Goldby, seconded by Councilmember Emery, he ordered the meeting adjourned to Thursday, January 29, 1998 at 6:00 p.m. in the City Council Chambers.
