COVENANT REGARDING REAL PROPERTY

("OWNER" hereinafter), are the owners oheal property commoniy known as 13763 Paseo Valle Alto
("PROPERTY hereinafter), and more fully described as,
Lot 64 of City of poway Tract No 88-15 Unit No, 3, in the. City of Poway, COllntyof San
Diego, State of California according to Map thereof No 12467 filed in the office of the
County Recorder of San Diego COllnty, September 22,1989
In consideration of the approval ofa Building Permit to construct a 748-square-foot, detached
guest house on the referenced property by the City of Poway("CITY" hereinafter), OWNER hereby
agrees that the det~ched guest house shall never be rented_C{IJeased,as a,separate.unit;.no,complete -
- ~ - kiteheIYfacilities.shaWbeinstalied, anif no gas line and/or 220 ampere electrical service shall ever be
installed,
This Covenant shall run with the land. and be binding lIpon and inllre to the benefit of the future
owners, encllmbrances, successors, heirs, personal representatives, transferees and assigns of the
respective parties,
In the event that a Building Permit is never obtained to construct the proposed guest house at
the reqllest of the OWNER, the CITY shall expunge this Covenant from the record title of the
PROPERTY
If either party is reqllired to incur costs to enforce the provIsions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including reasonable attorneys'
fees, from the other party The CITY may assign to persons impacted by the performance of .this
