COVENANT REGARDING REAL PROPERTY
Ming Zhen Wu and Cherig Hua Duan, Husband and Wife as Joint Tenants ("OWNER"
hereinafter), are the owners of real property commonly known as 13721 Carriage Road ("PROPERTY
hereinafter), and more flllly described as:
Lot 245 of Golden City Unit No, 2,. in the City of Poway, COllnty of San Diego, State of
California, according to Map'thereof No 7066, filed in the Office of the County Recorder
of San Diego County, September 28, 1971
In consideration of the approval 'of a Building Permit to constrllcta 494-square-foot, attached
glle.stl;1puse on the referenced property by the City of Poway ("CITY" hereinafter), OWNER hereby
agrees that the attached guest house shall never be rented or leased as a separate unit, no complete
kitClien facilities shall be installed, arid no gas line and/or 220 ampere electrical service shall ever be
installed,

owners, encllmbrances, successors, heirs, personal representatives, transferees and assigns of the

In the event that a BlIilding Permit is never obtained to construct the proposed guest hOllse at
the request of the OWNER, the CITY shall expllnge this Covenant from the record title of the
PROPERTY
If either' party is required to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbllrsement of all costs, including reasonable attorneys'
