A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
AMENDING THE APPEAL FEE CONTAINED IN THE MASTER SCHEDULE OF FEES
WHEREAS, on December 11, 2007, the City Council adopted a Master Schedule
of Fees, and
WHEREAS, California Government Code Section 66016, et. seq., establishes
procedures for the adoption of fees for services provided by local government; and
WHEREAS, the processing of an appeal will require staff time to investigate the
circumstances surrounding the application, and
WHEREAS, the established fee of $1 425 may deter an appeal from being filed;
and
WHEREAS, any additional costs incurred will be borne by the City's General
Fund
NOW, THEREFORE, the City Council does hereby resolve as follows
Section 1 The City Council finds that this amendment to the Master Schedule of
Fees is exempt from the requirements of CEOA pursuant to CEOA Guidelines Section
15273 (a) (1) because it would establish a fee necessary to meet the City operating
expenses to process appeals of staff decisions to the City Council.
Section 2. The City Council hereby modifies the fee for processing of an appeal to
the City Councilor project rehearing from $1,425 to $200
PASSED, ADOPTED and APPROVED by the City Council of the City of Poway,
State of California, this 19th day of August 2008
