Res P-08-22 RESOLUTION NO P-08-22 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING HILLSIDE/RIDGELlNE MINOR DEVELOPMENT REVIEW APPLICATION 08-47WCF ASSESSOR'S PARCEL NUMBER 272-761-46 WHEREAS, Hillside/Ridgeline Minor Development Review Application (MDRA) 08-47WCF, Bruce and Allison Dahlgren, Applicants, request approval to construct a 6-foot-high retaining wall and perform associated grading on a 2.6-acre property located at 13210 Highlands Ranch Road, within the Rural Residential C zone, and WHEREAS, on September 23, 2008, the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to this application NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows Section 1 The City Council finds that the proposed project is Categorically Exempt as a Class 4 Categorical Exemption, pursuant to Section 15304 of the CEQA Guidelines, in that the project involves the minor alteration of land Section 2. The findings, in accordance with Section 1752 of the Poway Municipal Code (PMC), to approve Hillside/Ridgeline MORA 08-47WCF as shown on the conceptual grading/site plan dated July 31,2008, on file with the Development Services, are made as follows A. That the approved project is consistent with the General Plan as it proposes the construction of a retaining wall and associated grading in connection with the construction of a single-family residence on property that is designated for residential use Therefore, the proposed use respects the interdependence of land values and aesthetics to the benefit of the City B That the approved project will not have an adverse affect on the aesthetics, health, safety, or architecturally related impact upon adjoining properties, as the grading and retaining wall are consistent with surrounding residential development. Therefore, the proposed design, size, and scale of the proposed retaining wall is compatible with and will not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources C That the granting of the MDRA would not be materially detrimental to the public health, safety, or welfare since the proposed use will complete improvements as deemed necessary Resolution No P-08-22 Page 2 D That the approved development encourages the orderly and harmonious appearance of structures and property within the City, as the neighboring properties consist of low-density residential lots. Therefore, the proposed development respects the public concerns for the aesthetics of development. E That the proposed use will not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity nor be contrary to the adopted General Plan F That the proposed development will comply with each of the applicable provisions of the Zoning Ordinance and the General Plan Section 3 The City Council hereby approves Hillside/Ridgeline MDRA 08-47WCF, to allow the construction of a 6-foot-high retaining wall and associated grading in connection with the construction of a two-story, replacement house on a 2.6-acre Witch Creek Fire impacted property located at 13210 Highlands Ranch Road, within the Rural Residential C zone, as shown on the conceptual grading/site plan dated July 31,2008, subject to the following conditions. A Approval of this Minor Development Review Application shall apply only to the subject project, and shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at the time of Building Permit issuance B Within 30 days of approval the applicant shall submit in writing that all conditions of approval have been read and understood C Development on the site must comply with the Poway Noise Ordinance (Chapter 808 PMC) Construction work is specifically regulated by PMC 8 08 100, which states that it is unlawful for the operation of any single or combination of powered construction equipment at any construction site on Mondays through Saturdays except between the hours of 7'00 a.m. and 5'00 p.m., or at any time on a Sunday or holiday except as provided in PMC 8 08 100 D The applicants shall obtain a Grading Permit prior to grading Prior to issuance of a Grading Permit: (Engineering) 1 A grading plan prepared by a civil engineer for the construction of the retaining wall and slope setback for fire safety, prepared on a City of Poway standard engineering D-sheet, to a scale of 1" = 20', shall be submitted to the Engineering Division. The grading plan shall show the following: Resolution No P-08-22 Page 3 a. A separate erosion prevention and sediment control plan for construction activities. This plan shall provide for an on-site de-silting basin with a volume based on 3,600 cubic feet per tributary acre drained b Locations of all utilities, together with the easements c. All new slopes shall have a maximum 2 to 1 ratio (horizontal to vertical). d. Top of footing, top of wall, and finish grade elevations at retaining wall. If the retaining wall is to be stepped, a profile shall be shown on the grading plan. Rebar callout shall be per Regional Standard Drawings. If there is a deviation from the Regional Standard Drawings for the proposed wall, and a special design wall will be required, structural calculations shall be provided to the Poway Engineering Division, with a separate plan checking fee, for approval. e Typical wall cross-sections. Footing to daylight shall be at least seven feet. f A suitable drainage system for the retaining wall. This could consist of a layer of waterproofing, weep holes, back drain, or combination thereof 2. A soils/geological report shall be prepared by an engineer licensed by the State of California to perform such work, and shall be submitted with the grading plan 3 The report shall include design parameters for the proposed retaining wall, as well as recommendations for wall backfill and preparation of ground for wall footing. A foundation stability analysis is to be included with the report. 4 Grading securities in the form of a performance bond and a cash deposit, or a letter of credit shall be posted with the City prior to grading plan approval. A minimum $2,000 cash secu rity deposit IS required Additionally, the applicant shall submit payment for plan check, permit, soils report review, and inspection costs. The payment schedule shall be based on the fee schedule which existed as of October 23, 2007 5 The applicant shall attend a pre-construction meeting, at which time they shall present an Action Plan that identifies measures to be implemented during construction to address erosion, sediment, and pollutant control. Resolution No. P-08-22 Page 4 Compliance for sediment control shall be provided using the following guidelines, as directed by the City Inspector' a. Provision of an onsite de-silting basin with a volume based on 3,600 cubic feet per tributary acre drained b Covering of all flat areas with approved mulch c Installation of an earthen or gravel bag berm that retains three inches of water over all disturbed areas prior to discharge, effectively creating a de-silting basin from the pad. (Planning) 6 A Vegetation ManagemenULandscape Plan shall be submitted to the Planning Division for review and approval. Said plan shall be prepared pursuant to the City of Poway Guide to Landscape Requirements, as it relates to Vegetative Fuel Management Zones for fire safety A $525 landscape plan check fee shall be submitted at the time of the landscape plan submittal. All disturbed slopes of greater than 5 1 slope shall be planted and irrigated with a variety of landscaping, including trees, shrubs and ground cover, to ensure stability Groundcover shall be hydroseeded, or hand-planted cuttings shall be appropriately spaced to eventually control soil erosion E. Prior to issuance of a Certificate of Occupancy for the house currently under construction. 1 All earthwork for the retaining wall is to be completed and meet the approval of the City Inspector, and shall include submittal of the following a. A certification of line and grade, prepared by the engineer of work. b A final soil compaction report for review and approval by the City 2 Site drainage improvements, slope planting measures, retaining wall, and all utility services shall be installed, and completed by the property owner, and inspected by the Engineering Inspector for approval. All new utility services shall be placed underground An adequate drainage system around the new building pad capable of handling and disposing all surface water shall be provided to the satisfaction of the Engineering Inspector 3 The applicant shall repair, to the satisfaction of the City Engineer, any and all damages to the streets caused by construction activity from this project. Resolution No. P-08-22 Page 5 4 Record drawings, signed by the engineer of work, shall be submitted to Development Services prior to a request of occupancy, per Section 1652.130B of the Grading Ordinance Record drawings shall be submitted in a manner to allow the City adequate time for review and approval prior to issuance of occupancy and release of grading securities. 5 Brush Management and slope landscaping shall be completed to the satisfaction of the Director of Development Services and the Director of Safety Services in accordance with the approved Brush Management Plan. Section 4 The approval of Hillside/Ridge Minor Development Review Application 08-47WCF shall expire on September 23, 2010, at 5:00 p.m. unless a Building Permit has been issued, and construction or use of the property in reliance on this permit has commenced prior to its expiration.
