ONE-QUARTER CENT SALES TAX
FOR LIBRARY PURPOSES
Councilmember Goldby stated he pulled this item from the Consent Calendar because he

CITY ATTORNEY ITEMS

City Attorney Eckis stated that the Pacific Legal Foundation is filing a brief in the
case of Poway Property Owners v. City of Poway. This is the Habitat Conservation
Case. They are raising an issue regarding the implementing agreement with the
Federal Government.

City Attorney Eckis stated he is filing an Amicus brief in the case of Del Monte
Dunes v. City of Monterey. The issue was whether a denial of a land use
application was a taking. The case was given to a jury to decide and to determine
damages. Allowing a jury to determine the reasonableness of a governing board's
action is new law.

17.
Councilmember Goldby announced there had been a symbolic signing of the Metre
wastewater agreement at the San Diego City Council meeting. It marks the end of
three years of negotiating.
