CC 1998 05-19 CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING MAY 19, 1998 The May 19, 1998, regular meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Mayor Higginson at the City Council Chambers, 13325 Civic Center Drive, Poway, California. PUBLIC ORAL COMMUNICATIONS Mayor Higginson explained the procedure for Public Oral Communications. The following person was present wishing to speak: Bill Cross, 13107 Corona Way, representing the Senior Issues Committee, invited the City Council and staff to attend the dedication of the new senior center bus on May 28, 1998 at noon. CONSENT CALENDAR Councilmember Goldby asked to pull Item 11. Motion by Councilmember Rexford, seconded by Councilmember Cafagna to approve the Consent Calendar, as follows: 6366 Page 2 - CITY OF POWAY - May 19, 1998 o 10. 11. 12.1 12.2 Motion Ratification of Warrant Register for period of April 27 - May 1, 1998. (401-10) Approval of Minutes - City Council April 28, 1998 - Regular Meeting Denial of claim against the City: Luther L. Newcomb. (704-13) Acceptance of Dog Park Lighting at Poway Community Park from Creative Lighting, Inc. (602-01 #1234) Appropriation of funds for Community Park Soccer Field Fencing Project~401-13) Extension of Dead Animal Removal Services Contract for two additional option years from July 1, 1998 through June 30, 2000. (602-01 #879) Allocation of $40,000 in funds for a new telephone system at the Weingart Senior Center. (401-13) Approval of Parcel Map for Tentative Parcel Map 97-05, McMahon/Oliphant Properties, located at the northwest corner of Stowe Drive and Crosthwaite Circle. (203-02) Adoption of Resolution No. 98-050, entitled, "A Resolution of the City Council of the City of Poway, California Establishing a No Stopping, Standing, or Parking Zone on Carriage Road", south of Poway Road, on the east side 300 feet, and west sides, 210 feet (1163-01 ) Resolution No. 98-051 - entitled, "A Resolution of the City Council of the City of Poway, California Establishing Time Limited Parking Restrictions on Montero Road", effective between 8-10 a.m. and 2-4 p.m., school days only on both sides of Montero Road through the cul-de-sac and west 120 feet. (1163-01) Appropriation of $10,250 to Conduct the Weingart Center Needs Assessment Survey. (1401-01) Appropriation of $198,210 and approval of modification of existing contract with Astro Mechanical/Gas Line Replacement project at Poway Royal Estates Mobile Home Park to include installation of underground storm drains. (602-01 #270R) carried unanimously. 6367 Page 3 - CITY OF POWAY - May 19, 1998 ITEM 12 (702-00) ONE-QUARTER CENT SALES TAX FOR LIBRARY PURPOSES Councilmember Goldby stated he pulled this item from the Consent Calendar because he is opposed to increasing taxes. Fiscal responsibility, not a tax increase, would solve the problem of library funding. Motion by Councilmember Emery, seconded by Mayor Higginson to adopt Resolution No. 98-052, entitled, "A Resolution of the City Council of the City of Poway, California Supporting the Approval of the Library Sales Tax Initiative on the March, 1999 Ballot to Enact Within San Diego County a One-Quarter Cent Sales Tax for Five Years to be Used Exclusively for Library Improvements." Motion carried 3-2 with Councilmembers Cafagna and Goldby voting "no." CITY ATTORNEY ITEMS 14A. City Attorney Eckis stated that the Pacific Legal Foundation is filing a brief in the case of Poway Property Owners v. City of Poway. This is the Habitat Conservation Case. They are raising an issue regarding the implementing agreement with the Federal Government. 14B. City Attorney Eckis stated he is filing an Amicus brief in the case of Del Monte Dunes v. City of Monterey. The issue was whether a denial of a land use application was a taking. The case was given to a jury to decide and to determine damages. Allowing a jury to determine the reasonableness of a governing board's action is new law. MAYOR AND CITY-COUNCIL INITIATED ITEMS 17. Councilmember Goldby announced there had been a symbolic signing of the Metre wastewater agreement at the San Diego City Council meeting. It marks the end of three years of negotiating. 18. Councilmember Rexford requested a report regarding staffing at the Sheriff's station at night. 6368 Page 4 - CITY OF POWAY - May 19, 1998 ADJOURNMENT Mayor Higginson adjourned the meeting at 7:14 p.m. and reminded the City Council that, pursuant to the adopted calendar, the meeting of May 26, 1998 is canceled. rvla~'jorie K.
