Res 08-077 RESOLUTION NO 08-077 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA INITIATING GENERAL PLAN AMENDMENT 08-03 AND SPECIFIC PLAN 08-01 WHEREAS, the City Council of the City of Poway recognizes that the need may arise to amend the City's General Plan; and WHEREAS, Section 65350, et seq" of the California Government Code describes the procedures for amending General Plans, and WHEREAS, Section 1746020B of the Poway Municipal Code (Zoning Ordinance) provides that a change in the boundaries of any zone or a change in regulations may be initiated by Resolution of the City Council and Section 1747 020C provides that the preparation or amendment of a Specific Plan may be initiated by Resolution of the City Council; and WHEREAS, on October 7,2008, the City of Poway held a properly noticed public hearing in accordance with the California Government Code, and WHEREAS, General Plan Amendment 08-03 consists of the initiation of the re-designation of two parcels, totaling 405 acres, located east of Midland Road, between Edgemoor Street and Adrian Street, from Residential Single-Family 7 (RS-7) and Commercial General (CG) to Residential Apartment (RA/AH), and the placement of an Affordable Housing (AH) Overlay Zone over one acre parcel; and WHEREAS, Specific Plan 08-01 consists of the initiation of a Specific Plan that guarantee the unit rents within the AH project do not exceed affordable levels, as well as detailed development criteria that customize the project to the site NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows Section 1 Initiation of a proposed General Plan Amendment and/or Specific Plan is not subject to CEQA review Section 2 The City Council hereby approves the Initiation of General Plan Amendment 08-03 to change the zoning and land use of two parcels located east of Midland Road, between Edgemoor Street and Adrian Street, from RS-7 and CG to RA, the placement of an Affordable Housing Overly over the one acre parcel; and the creation of Specific Plan 08-01 that will guarantee the unit rents within the AH project do not exceed affordable levels, as well as detailed development criteria that customize the project to the site Resolution No 08-077 Page 2 PASSED, ADOPTED and APPROVED by the City Council of the City of Poway, State of California, this 7th day of October 2008 -~,-- ATTEST ( Penny Riley, Dep'uty City CI rk STATE OF CALIFORNIA ) ) SS COUNTY OF SAN DIEGO ) I, Penny Riley, Deputy City Clerk of the City of Poway, do hereby certify, under the penalty of perjury, that the foregoing Resolution No 08-077, was duly adopted by the City Council at a meeting of said City Council held on the 7th day of October 2008, and that it was so adopted by the following vote AYES BOYACK, HIGGINSON, REXFORD, CAFAGNA NOES NONE ABSENT EMERY DISQUALIFIED NONE '" Pennly Ril~y, De uty City CI~ CitYOf~
