ORDINANCE NO 680
AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA,
AMENDING CHAPTER 13.24 OF THE POWAY MUNICIPAL CODE
BY AMENDING SECTION 1324030 CONCERNING REIMBURSEMENT
FOR PERMANENT IMPROVEMENTS
WHEREAS, Chapter 13.24 of the Poway Municipal Code governs the process for
City Council approval of developer reimbursement agreements These agreements
allow developers or property owners who extend or develop permanent improvements
that benefit other properties, such as water or sewer improvements, to be reimbursed
for the cost of the improvements from those who benefit from them, and
WHEREAS, Chapter 13.24 currently requires that an application for approval of a
developer reimbursement agreement must be submitted to the City Engineer prior to the
commencement of construction, at the same time as the standard agreement and
bonding is submitted for the construction, and
WHEREAS, the City has determined that it would be beneficial to allow for more
flexibility in this process by allowing applications for reimbursement agreements to be
submitted to the City Engineer after the commencement of construction, but prior to
acceptance of the improvements by the City; and
WHEREAS, it has been determined that there is a need to update Chapter 13.24
by amending Section 13.24 030, to allow for more flexibility in the approval process for
reimbursement agreements
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES
ORDAIN AS FOLLOWS
SECTION 1 Section 13.24 030 is modified to read as follows
13.24 030 Application requirements.
The owner(s) shall provide to the City Engineer a completed reimbursement agreement,
which shall be submitted to the City Engineer prior to the acceptance of the
improvements by the City The owner(s) shall also provide a deposit to cover the
estimated City administrative costs to review, process, and approve the agreement
EFFECTIVE DATE. This Ordinance shall take effect and be in force thirty (30)
days after the date of this passage; and before the expiration of fifteen (15) days after
its passage, it shall be published once with the names and members voting for and
against the same in the Poway News Chieftain, a newspaper of general circulation
published in the City of Poway

Introduced and first read at a regular meeting of the City Council of the City of
Poway held this 23rd day of September 2008, and thereafter PASSED AND ADOPTED
at a regular meeting of said City Council held the 7th day of October 2008, by the
following roll call vote
