RESOLUTION NO P-08-28
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING THE TEMPORARY SUSPENSION OF THE TIME LIMITS TO DISPLAY
TEMPORARY SIGNAGE FOR MOTOR VEHICLE DEALERSHIPS
WHEREAS, a weak US economy, falling home values, consumers' inability to
access credit, and high gasoline prices combined to drop industrywide automobile sales
sixteen percent; and
WHEREAS, Poway's auto dealers have been similarly affected, and
WHEREAS, sales tax revenue generated by Poway auto dealers fell seventeen
percent in the first quarter of 2008, and
WHEREAS, auto sales are a significant source of sales tax revenue for the City,
representing more than twenty percent of all sales tax revenue, and
WHEREAS, industry analysts predict that this slump in sales will continue through
2009 and that we will begin to see some signs of recovery beginning in 2010
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows
Section 1. The foregoing recitals are hereby fully incorporated herein by this reference
and are deemed a material part of this Resolution.
Section 2 The City Council of the City of Poway hereby approves temporarily suspending
enforcement of the following City Code provision as follows.
A Poway Municipal Code Section 17 40 190 C, Temporary Signage for Motor Vehicle
Dealerships, subdivision 4, Days Allowed. Enforcement of the 3 day time limit (Friday,
Saturday and Sunday) imposed by PMC Section 1740 190(C)(4) with regard to temporary
signage for motor vehicle dealerships is hereby suspended for a period of twelve (12)
months from the effective date of this Resolution. All other provisions of PMC Section
17 40 190 shall remain in full force and effect
Section 3 Notwithstanding any other provision of this Resolution, the City Council
reserves the right to terminate, at any time, the twelve (12) month suspension period set
forth in Section 2 herein. Any such termination shall be by majority vote of the City Council
at a duly held City Council meeting
Section 4 This Resolution shall become effective immediately upon adoption by the City
Council of the City of Poway, California.
