addressed as 13630 Ash Hollow Crossing ("PROPERTY" hereinafter), and more fully described as:

PHASE 1, UNIT 1, IN THE CITY OF POWAY, COUNTY OF SAN DIEGO, STATE OF
CALIFORNIA, ACCORDING TO MAP THEREOF NO 13339, FILED IN THE OFFICE

Development Review Application 03-40, involving a 1,000-square-foot guest house, OWNERS
hereby agree that no portion of the guest house shall ever be rented or leased as a separate unil,
complete kitchen facilities shall not be installed, and no gas line and/or 220 ampere electrical
service shall ever be installed,
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrancers, successors, heirs, personal representatives, transferees and
assigns of the respeclive parties,
In the event that Minor Development Review Application 03-40 expires or is rescinded by
City Council, and building permits are never obtained to construct the proposed addition, CITY shall
at lhe requesl of OWNER expunge this Covenant from the record title of PROPERTY
In the event of litigation to en~orce the provisions of this Covenant, the prevailing party shall
be entitled to full reimbursement of all costs, including reasonable attomeys' fees, from the other
party
