Development Review Application 03-74 involving a 364-square-foot guest house, OWNERS hereby agree

This.Covenant shall run with the land and be binding upon and inure to the benefit of the future

In the event that Minor Developme[1t Review Applicajion MDRA 03-74 expires or is rescinded by
City Council, and building permits are never obtainedto'construcUne proposed addition, CITY shall at the
request of OWNER expunge this Covenant from the record title cif PROPERTY
In the event of Iiligation to enforce the provisions of this Covenant, the prevailing party shall be
entitled to full reimbursement of all costs, inchiaing reasonable attorney.;' fees, from the other party.
