COVENANl' REGARDING REAL PROPERTY
Whereas ITE, LLC, PROPERTY OWNER ("OWNER" hereinafter) are the owners of real property
located at 14008 Lake Poway Road ("PROPERTY" hereinafter), and more fully described as:
Parcel 3 of Parcel Map No. 18911 in the City of Poway, County of San Diego, State of
California, according to Map thereof filed in the Office of the County Recorder of San Diego
County, March 1, 2002,
In consideration of the approval by the City of Poway ("CITY" hereinafter) of Minor Development
Review 00-149, involving construction of an approximately 5,013-square-foot single-family residence,
OWNER hereby agrees to the following:
No obstructions, including, but not Iimiled to, gates, walls, boulders, and landscaping, as
determined by the Fire Marshall, will be constructed or maintained on PROPERTY that
would encroach into the fire apparatus turnaround area required for PROPERTY and
neighboring property addressed as 14002 Lake poway Road, Poway, as shown on
Attachment A,
This Covenant shall run with the land and be binding upon and inure to the benefit of the future
owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of lhe
respective parties,
In the event of litigation to. enforce ,the provisions of this Covenant, the prevailing party shall be
entitled to full reimbursement of all costs, including reasonable attorneys' fees, fr?m the other party
