Whereas ITE, LLC, PROPERTYOWN1;~ ("OWNER" hereinafter) are the owners of real property
located at 14002 Lake Poway Road ("PROPERTY" hereinafter), and more fully described as:
Parcel 40f Parcel Map No, 189U .in the City of Poway,County of San Diego, State of
California, according to Map thereof filed in the Office of;the County Recorder of San Diego
County, March 1, 2002.
In consideration of the approval by the. City of Poway ("CITY" hereinafter) of Minor Development
Review 00.150R, involving construction of an approximately 4,200'square-foot single-family
residence, OWNER hereby agrees to the following:
No obstructions, including, but not limited to, gates, walls, boulders, and landscaping, as
determined by the Fire Marshall; will: be constructed or mairitained on PROPERTY that
would encroach into the fire apparatus turnaround area required for PROPERTY and
neighboring property addressed as 14008 Lake 'poway Road, Poway, as shown on
AttachmentA
This Covenant shall run with'othe land and be binding upon and inure to the benefit of the future
owners, encumbrances, successors, heirs: personal representatives, 'lransferees and assigns of the
respective p,arties,
In the even! of litigation to enforce the provisions of this Covenant, the prevailing' party shall be
entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the other party
