COVENANT REGARDING REAL PROPERTY
Susan K, Williams and David T Williams, Wife and Husband, as Joint Tenants,
("OWNERS" hereinafter), are tt)e oWrlers of real property described in Exhibit "A" which is
attached hereto and made a part hereof and which is commonly known as Assessor's Parcel
Number 277,191-08 ("PROPERTY hereinafter),
In consideration of the approval of a Building Permit to construct a 640-square-foot,
detached pool house on the, referenced property by the City of Poway ("CITY" hereinafter),
OWNER hereby agrees that the detached pool house shall never be rented or leased as a
separate unit, no complete kitchen facilities shall be installed, and no gas line and/or 220
ampere electrical service shail ever be installed except for in the water heater area, and used
solely for water heater purposes,
This Covenantshall run withthe land and be binding upon and inure to the benefit of the
future owners, encumbrance's, successors, heirs, personal representatives, transferees and
assigns of the respective parties,
In the eventthat Building' Permits are never obtained to construct the proposed detached
pool house, at the request of .the OWNER, the CITY shall expunge this Covenant from the
record title of the PROPERTY
If either party is required to incur costs to enforce the provisions of this Covenant. the
prevailing party shall be entitled to full reimbursement of all costs. including reasonable
attorneys' fees, from the other party The CITY may assign to persons impacted by the
performance of this Covenant the right to enforce this Covenant against the OWNERS
