\ COVENANT REGARDING REAL PROPERTY
Whereas Dynasty Development, LLC/Allen Basile, PROPERTY OWNER ("OWNER"
hereinafter) is the owner ofJeal property commonly known as a portion of Assessor's Parcel Number
320-020-16 ("PROPERTY" hereinafter), and more fully described as:
Parcel 4 of CITY OF POWAY Parcel Map 01-05, IN THE CITY OF POWAY, COUNTY
OF SAN DIEGO, STATE OF CALIFORNIA, ACtORDING TO MAP THEREOF NO
19409, FILED IN THE OFFICE OF THE COUNTY RECORDER OF SAN DIEGO
COUNTY, on the 220d day of January, 2004
In consideration of the approval by the City of Poway ("CITY" hereinafter) of TPM 01-05,
involving the subdivision of a 2,53-acre propertylocated at 11550 Creek Road intofour (4) parcels"
OWNER hereby agrees that:
1 Future Development on Parcel 4 shall consist of the following:
a, A low profile, single-story, multi-level foundation design that follows the natural
contours of the land. The design is required to have varied roof heights and
styles to create attractive, interesting buildihg elevations. The maximum height
of the residence cannot exceed 25 feet, as measured from the building pad to
the highest point on the ridge of the roof. Said design shall be reviewed and
approved prior to Grading Permit issuance,
b Comply with the Hillside Development Strategies of the Poway General Plan,
c, A 6-foot-high wood fence shall be installed adjacent,to the dril.eway, along the
northeasterly property line adjacent to the yard area on the neighboring property
The purpose ofthe fence is to allow rear and side yard privacy, and to screen
future vehicle lights from shining in the adjacent residence,
d, To lessen the need to grade' on the,s!eeper westerly portion of the property,
development shall be sited as close as possible to the easterly side property line
and the pad elevation of the residence shall be IO\Nered,
e City Council approval is not required for a reduction in height of the building pad
elevations shown on the conceptual grading design for the subdivision dated July
29, 2002.
f The grading design for the access driveway up to the easterly, side property line
of Parcel 4 shall be modified to lower the surface elevation to be consistent with
the adjacent existing grade,

This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrancers, successors, heirs, personal representatives, transferees and
assigns of the respective parties,
In the event of litigation to enforce the provisions of this Covenant, the prevailing party shall
be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the other
party
