Trustees of the Gatti Famil Trust dated Se tember 7 1996',(hereinafter "G~NTOR") hereby
grants to CITY OF POWAY, (hereinafter "GRANTEE"), its successors, or assigns express
permission to construct a concrete masonry sound wall along ,tbe westerly edge of the subject
property line, at or along the alignment of the existing chain link fence, as well as, the
Temporary Construction EaserhenVahd ihcidehts thereto for construction of a sound wall across
that certain real property in the City of P'bway, County of San Diego, State of California.
o From the Westerly Property Line to the EasterlyTop of the Drainage Culvert
The GRANTOR, hereby further 'grants to the City of Poway the privilege and right to extend
excavation and embankment ,slopes within the limits of the herein described Temporary
Construction Easement, wtiereTequired for the construction and maintenance of said sound
wall.
The GRANTOR. for him/herself, his/her successors and assigns, hereby waives any claim for
any and all severance damages to GRANTOR's remCiining property contiguous to the
Temporary Construction Easement hereby conveyed by reason of the location, construction,
landscaping, or maintenar:1ce of said easement. /
The GRANTOR hereby fur:ther'grants to GRANTEE the rigtiFto temporarily 'enter and construct
necessary Telated irnprovements as'part of the proposed construction process. This Temporary
Construction Easement, as described, shall be valid' oriiy until the construction has beer:1
accepted by the GRANTEE. After such time, the Temporary Construction Easement shall
become,null and'void.
