COVENANT REGARDING REAL PROPERTY 2004-12315.78
Whereas Anthony Garczynski and Patricia L. Garczynski, Trustees under Declaration
of Trust dated January 13, 2003, PROPERTY OWNERS ("OWNERS" hereinafter), are the owners
of real property commonly known as Assessor's Parcel Number 275-072-11 ("PROPERTY"
hereinafter), and more fully described as:
LOT 15 OF GREEN VALLEY ESTATES, IN THE CITY OF POWAY, COUNTY OF SAN
DIEGO, STATE OF CALIFORNIA, ACCORDING TO MAP THEREOF NO 3455, FILED IN THE
OFFICE OF THE COUNTY RECORDER OF SAN DIEGO COUNTY, JULY 3, 1956
In consideration of the approval by the City of Poway ("CITY" hereinafter) of Minor
,Development Review Application (MDRA) 04~30, irivolving a 570-square-foot guest house,
OWNERS hereby agree that no portion of the guest hou,se shall ever be rented or leased as a
separate unit, complete kitchen facilities shall not be installed, and no gas line and/or 220 ampere
electrical service shall ever be installed,
This Covenant shall run with the land and be binding upon ,and inure to the benefit of the
future owners, encumbrances, successors, heirs, personal representatives, transferees and assigns
of the respective parties,
lri the event that MDRA 04-30 expires or is rescinded by City Council, and building permits
are never obtained to construct the proposed guest house, CITY shall at the request of OWNER

expunge this Covenant from the record title of PROPERTY
In the eventof litigation to enforce the provisions of this Covenant, the prevailing party shall
be entitled to full reimbursement of all costs, including reasoriable attorneys' fees, from the other
party
