COVENANT REGARDING REAL PROPERTY
Dynasty Development, LLC, Owner ("OWNER"hereinafter-), is the owner of real property
which is commonly known as Assessor's ,Parcel Number 320-020-39, located at 11552 Creek
Road, Poway, CA ("PROPERTY hereinafter) and more fully described as:
Parcel 1 of City of poway Parcel. Map 01-05, in the City of Poway" County of
San Diego, State of clilif()rflia, According to Map ~hereof No.. 19409 filed in
the ,office of the county~Recorder of San Diego County,. January 22,,2004.
In consideration of approval of Minor Development Review Application 03-19 on the
referenced property by the City of Poway ("CITY" hereinafter),OWN'ERhereby agrees that outdoor
light fixtures, including, but not Iilllited to, decorative buijding and landscape lighting, must be

shielded ana directed in a downward orientation to prevent light spillage impacts on the nearby
biological resources, the street, or surrounaing properties.
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrances, successors, heirs, personal representatives, transferees and
assigns of the respective parties,
If either party is required to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including reasonable attorneys'
'fees, from the other party The CITY may assign to perso[1s impagted by the performance of this
Covenant the right to enforce this Covenant against OWNER.
