,Gabriel S. Delpuerto (hereinafter'''GRANTOR'') hereby grahts to 'CITY Of POWAY, (hereinafter
"GRANTEE"), its successors, or assigns express permission to .construct a concrete masonry
sound ,wall along the westerly edge'of the subject property line, at or along the alignment of the
existing chain link fence,. as well as, the Temporary Construction Easement and incidents
thereto for construction of a sound wall across that certain real property in the City of Poway,
County of San Diego, State of California.
From the Westerly PropE!rlyLine to the Easterly Top of the Drainage Culvert
The GRANTOR, hereby furttter gr,an.ts to the City of Poway the privilege and right to extend
excavation and embarikmenlslopes within the limits of the herein described Temporary
Construction Easement, where required for the construction and maintenance of said sound
wall.
The GRANTOR, for him/hers.elf, his/tier successors and 'assigns, hereby waives any claim for
any and all severance damages to GRANTOR's rel)iaining property contiguous to the
Temporary Construction Easement hereby conveyed by reason of the location, construction,
landscaping, or maintenance of said easement.
The GRANTOR hereby further grants to GRANTEE the rightto ternporarily enter and construct
necessary related'improvements'as,part,of.the proposed construc!io'.1 process. This Temporary
Constructioh Easement, as described; shall be' 'valid only'until the'constructiOn has been
accepted by the GRANTEE. Afiersuchtrme, the TemporaryConstiuction Easement shall
become null and'void:
