CC 1998 09-29 CiTY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING SEPTEMBER 29, 1998 The September 29, 1998, regular meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Mayor Higginson at the City Council Chambers, 13325 Civic Center Drive, Poway, California. PRESENTATIONS A. Jill Baker, Tierra Bonita teacher, Poway Unified School District, provided a brief verbal and viewgraph presentation on the "Picture Yourself in Local Government Summer Institute, 1998" held in Sacramento, California. She attended with the funding assistance by the City and will be implementing the curriculum within her classroom as well as teaching it to others in the district. PROCLAMATIONS Deputy Mayor Goldby proclaimed "Fire Prevention Week - October 4-10, 1998," and presented it to Mark Sanchez, Director of Safety Services. 6461 Page 2 - CITY OF POWAY - September 29, 1998 PUBLIC ORAL COMMUNICATIONS Mayor Higginson explained the procedure for Public Oral Communications. There was no one present wishing to speak. CONSENT CALENDAR Deputy Mayor Goldby requested Item 5 be pulled from the Consent Calendar. Councilmember Cafagna requested Item 7 be pulled from the Consent Calendar. Motion by Councilmember Emery, seconded by Councilmember Cafagna, to approve the Consent Calendar, as follows: 2. Ratification of Warrant Register for period of September 7-11, 1998. (401-10) Approval of Minutes - City Council September 15, 1998 - Regular Meeting Approval of Minutes - Redevelopment Agency September 15, 1998 - Regular Meeting 6. Rejection of Claim for Damages: Brian Dacus. (704-13) Determination of Substantial Conformance with Resolution of Approval No. P-90-33 for Tentative Parcel Map 89-12, a four lot subdivision located at the easterly terminus of Orchard View Lane. (203-02) Confirmation of the appointment of Mary Reed as Community Group Representative to the Performing Arts Advisory Committee for a One Year Period. (701-09) 10. Authorization for Purchase of Used Vehicle from Perry Ford at a cost of $20,933. (1998 Ford Mustang). (601-03) ITEM 1 (203-01) ENVIRONMENTAL ASSESSMENT TENTATIVE TRACT MAP 98-01 APPLICANT: DAVID JAClNTO Mayor Higginson opened the public headng. Staff report by City Manager Bowersox. Council requested staff bdng back in workshop form, an analysis of property remaining in High Valley that could be developed and information on standards, lot width, lots of 4 or more acres that could be subdivided, slope etc. Motion by Councilmember Goldby, seconded by Councilmember Cafagna, to close the public hearing, issue a Negative Declaration and adopt Planning Resolution No. P-98-53, entitled "A Resolution of the City Council of the City of Poway, California, Approving Tentative Tract Map 98-01 Assessor's Parcel Number 321-090-10 and 17." Motion carried 4-1 with Councilmember Emery voting no. 6463 Page 4 - CITY OF POWAY - September 29, 1998 ITEM lA (1404-05) TRAILS STATUS REPORT NAMING OF JUSTIN'S TRAIL City Manager Bowersox provided an overview of the staff report covering the public riding and hiking trails in north Poway. Additionally, a section of the trail along Old Coach Road is proposed to be named "Justin's Trail" in memory of Justin David Sabin, a Poway resident of fourteen years, Poway High School Graduate and Eagle Scout with a Poway Boy Scout troop at the age of 14, who died of cystic fibrosis on April 22, 1998. Motion by Councilmember Emery, seconded by Councilmember Cafagna, to receive and file the status report on trails in North Poway and adopt Resolution No. 98-096, entitled, "A Resolution of the City Council of the City of Poway, California, Naming a Portion of Trail Adjacent to Old Coach Road in Honor of Justin David Sabin." Motion carded unanimously. ITEM lB (602-01 #282R) BURLICH CORPORATION SETTLEMENT AGREEMENT Staff report by City Manager Bowersox. This Settlement Agreement and Modification of Promissory Note settles a dispute between the City and Burlich Corporation by the City discharging a disputed $24,000 water bill, Burlich discharging a $100,000 set off on their Note and reducing the interest rate on the outstanding note to 6.75%, and the Redevelopment Agency proceeding with the filing of an I.R.S. Form 8038-G. Motion by Councilmember Goldby, seconded by Councilmember Cafagna, to approve the settlement agreement and authorize filing of an Internal Revenue Services Form 8038-G. Motion carried unanimously. ITEM 5 (408-01) CITY'S INVESTMENT REPORT Deputy Mayor Goldby stated that he had requested the Approval of Investment Report for period ending August 31, 1998 be pulled from the Consent Calendar for discussion. He then requested the investment report be presented under staff reports once a quarter in order to report more fully on the status of various investments. Motion by Mayor Higginson, seconded by Councilmember Cafagna, to approve the Investment Report for period ending August 31, 1998 and to have a quarterly presentation on the status. Motion carried unanimously. 6464 Page 5 - CITY OF POWAY - September 29, 1998 ITEM 7 (1503-06) GRAD-NITE STUDENT SAFETY At the June 30, 1998 City Council Meeting, Mayor Higginson requested staff contact personnel from the Poway Unified School District to discuss ways to ensure safety of student participants in all-night graduation parties. The Poway Unified School District, and parents that volunteer for the graduation night party at Poway High School have reserved a room for sleeping and will provide a continental breakfast. Parents will be stationed at the exit door to vedfy that the students are not too tired to drive. If they are unable to ddve, arrangements will be made for the student to be driven home. Councilmember Cafagna stated that he felt the newly developed program to be a fabulous idea and requested a report on how it worked after graduation June 1999. Motion by Councilmember Cafagna, seconded by Deputy Mayor Goldby, to receive and file the report. Motion carried unanimously. MAYOR AND CITY COUNCIL-INITIATED ITEMS 16. Councilmember Rex'ford presented Council with plaques she received on behalf of the City at the American Public Works Association San Diego-Imperial Counties Chapter Awards Ceremony. The first was for "Transportation Project of the Year - over $10 million - 1998 - Scripps Poway Parkway." The second, for "Structural Project of the Year- $2 - $10 Million - 1998 - Poway Library and Sheriffs Station Complex." ADJOURNMENT Mayor Higginson adjourned the meeting at 8:45 p.m. in support of the continued winning trend of the San Diego Padres, on motion by Councilmember Rexford, seconded by Councilmember Cafagna.
