Ross R & Natalie A. Elamparo (hereinafter "GRANTOR") 'hereby grants to CITY OF POWAY,
(hereinafter "GRANTEE"), its successors, or assigns express permission to construct a
concrete masonry sound wall along the westerly edge of the subject property line, at or along
the alignment ofthe existing chain IinUehce, as well 'as, the Ternporary Construction Easement
and if]cidents thereto for cons,lruction of a sound wall across that certain real property in the
City of Pbway, County ofSah Diego, State of California,
From the Westerly Property Line to the Easterly Top of the Drainage Culvert
The GRANTOR. hereby further grants to the City of Poway the, privilege and right to extend
excavation and embankment sloPi3s witbin the limits of thehereir:1 described Temporary
Construction Easement, where required for the construction and maintenance of said sound
wall.
The GRANTOR, for him/herself, his/her successors and assigns, hereby waives any claim for
any and all severance damages to GRANTOR's remaining property contiguous to the
Temporary Construction ,Easeni'eiithereby c'onveyed by reaso'li of the location, construction,
landscaping, or maintenance of said,easement.
The GRANTOR hereby further grants to GRANTEE the righH.o temporarily enter and construct
,necessary related improvemenis1as pariof the proposed construction process, This Temporary
Con'structibn Easement, asdescrib'ed, shall be valid. only until the construction has been
aq::eptedby the GRANTEE. After such time, the Temporary Construction Easement shall
become null and void.
