In consideration of the approval of a Building Permit to construct a 496-square'foot, detached guest house on the referenced property by the Cityof' poway ("CITY" hereinafter), . O,WNER hereby agrees that the detach.ed guest house shall never be rented or leased as a --- '- -- separate- unit, no conipYete kitchen facillties'shall be installed, and no gas' line and/or' 220 ampere electrical ~erviceshall ever be installed except for in the water heater area, and used solely for water heater purposes. This Covenant shall run with the land and be binding upon and inure to the benefit of the future owners, encumbrance's, successors, heirs, personal representatives, transferees and assigns ofthe respective parties. In the evenl.lhat Buildin9 Permits are never.obtained to construct the proposed detached guest house at the request of the OWNER, the CITY shall expunge this Covenant from the record title of the PROPERTY If either party is required to incur costs to enforce the provisions of this Covenant, the prevailing party shall be entitled to full reimbursement of .all costs, including reasonable attorl)~Ys' fees, from the other party The CITY may assign to persons impacted by the performance ofthis"Covenahl.lhe right to enforce this Covenant.against the OWNERS.
