Sweig, husband and wife as community property, ("OWNERS" hereinafter), are the owners of real property commonly known as Assessor's Parcel Number 278-442-09 ("PRORERTY hereinafter), and more fully described as: Lot 9 of City of Poway Tract No. 3545, in the City ofPbway, County of San Diego, State of California, according to Map'thereof NO.1 0432, filed in the Office of the County Recorder of San Diego County, July 15,1982: In consideration of the approval of a building permit to construct a 747-square-foot detached guest house/studio on the referenced property, adqressedas 15494 Oakstand Court, by the City of Poway ("CITY" hereinafter), OWNER hereby agrees that the detached guest house/studio shall never be renteq or leased as a separate unit, no kitchen facilities shall be installed, and no gas line and/or 2ib amperes electrical service shall ever be installed. This Covenant shall run with the land and be binding LjPOIl and inure to the benefit of the future owners, encumbrance's,suc;cessors, heirs, personal representatives, transferees and assigns of the respective parties.
