COVENANT REGARDING REAL PROPERTY
Whereas Van A. Tengberg and Sharon M, Tengberg, PROPERTY OWNER ("OWNER"
hereinafter) is the owner ofTeal prop~rtycommonly known as Assessor's Parcel Number 273-1 01-26
("PROPERTY" hereinafter), and rnore fully described as:
LOT 26 OF CITY OF POWAY TRACT 88-11, IN THE CITY OF POWAY, COUNTY OF
SAN DIEGO, STA TEOFCALlFORNIA, ACCORDING TO MAP THEREOF NO 12761,
FILED IN THE OFFICE OF THE COUNTY RECORDER OF SAN DIEGO COUNTY,
DECEMBER 28,1990
In consideration of the,approval by the City of poway ("CITY" hereinafter) of a Building Permit
for the construction of a 748-square-foot detached guest house, OWNER hereby agrees that no portion
of the guest house shall ever be rented or leased as a separate unit, no complete kitchen facilities shall
be installed, and no gas line and/or 220 arnpere electrical service shall ever be installed except for in
the laundry room and water heater area, and used solely for water heater and laundry purposes.
This Covenant shall run with the land and be binding upon and inure to the benefit of the future
owners, encumbrancers, successors, heirs, personal representatives, transferees and assigns of the
respective parties.
In the event that building permits are never obtained to construct the proposed guest house,
CITY shall. at the request of OWNER, expunge this Covenant from the record title of PROPERTY
In the event of litigation to enforce the provisions of this Covenant, the prevailing party shall be
entitled to full reimbursement of all costs, including reasonable attorne)5' fees, from the other party.
