RECORDER OF SAN DIEGO, NOVEMBER 8,1999, AS INSTRUMENT NO 99-743025,
In consideration of the approval by the City of Poway ("CITY" hereinafter) of Minor
Development ReviewApplication 04-13, involving a 1, 1 03-square~foot, two-story addition consisting
of two bedrooms, family room, and a four-car garage at 1150B Creek Road, OWNER hereby agrees
that no portion of the addition shall ever be rented or leased as a separate unit, complete kitchen

facilities shall not be installed, and no gas line andlor 220 ampere electrical service shall ever be
installed,

This Covenant shall run with. the land and be binding upon and inure to the benefit of the -
future owners, encumbrances, successors, heirs, personal representatives, transferees and assigns
of the respective parties,
In the event that Minor Development Review Application MDRA 04-13 expires or is

rescinded by City Council, and buildihg permits are never obtained to construct the proposed
addition, CITY shall at the request of OWNER expunge this Covenant from the record title of
PROPERTY
In the event of litigation to enforce the provisions of this Covenant, the prevailing party shall
be entitled to full reimbursement orall costs, including reasonable attorneys' fees, from the other
pa rty
