GRANT OF TEMPORARY CONSTRUCTION EASEMENT
FOR SCREEN WALL (AUBREY PARK, CIP PROJECT #5657)
NO DOCUMENTARY TRANSFER TAX DUE
Nicholas J. & Anna M. Pinto (hereinafter "GRANTOR") hereby grants to CITY OF POWAY,
(hereinafter "GRANTEE"), its successors, or assigns', the Temporary Construction Easement
and incidents thereto for construction of a screen wall across that cert.ain real property in the
City of Poway, County of San Diego, State of California, described as follows:
(The Easterly 5 Feet of APN No. 314-182'83)
The GRANTOR, hereby further ;grants to the City of poway the privilege and right to extend
excavation and embankment slopes within the limits of the herein described Temporary
Construction Easement, where required for the construction of said screen wall.
The GRANTOR, for him/herself, his/her successors and assigns, hereby waives any claim for
any and all severance damages to GRANTOR's remaining property contiguous to the
Temporary Construction Easement. Said severance damage relates to the market value of the
home.
The GRANTOR hereby further grants to GRANTEE the right to temporarily enter and construct
necessary related improvements as part of the proposed construction process. The GRANTEE
accepts liability for the construction activity therein, ThisTemporary Construction Easement, as
described, shall be valid only'untiflthe construction has I:leenaccepted by the GRANTEE. After
such time,'the Temporary ~onstruction ECisementshall b,ecome null and void.
