COVENANT 'REGARDING REAL PROPERTY
Gloria Bias, a married woman as her sole and separate property ("OWNER" hereinafter),
is the owner of real property commonly known as Assessor's Parcei Number 314-801-16
("PROPERTY hereinafter), and more fully described as:
Lot 243 of City of Poway Tract No. 4191-3BR, In the City of Poway, County of San
Diego, State of California, accordir;Jg to map thereof No. 12082, filed in the Office of the County
Recorder of San Diego County, May27, 1988.
In consideration of the approval of a Building Permit to construct a 708-square-foot,
detached guest house on the referenced property by the City of Poway ("CITY" hereinafter),
OWNER hereby agrees that the ,detached guest house shall never be rented or leased as a
separate unit, no complete' kitch.enfacilities shall be installed, and no gas line and/or 220
ampere electrical service shall ever be installed except for in the water heater area, and used
solely for water heater purposes.
This Covenant shall run"with the land and b~ binding upon and inure to the benefit of the
future owners, encurnbrances, successors, heirs, personal representatives, transferees and
assigns of the respective parties.
In the event that Building. Permits are never obtained to construct the proposed detached
guest house at the request of the OWNER, the CITY shall expunge this Covenant from the
record title of the PROPERTY.
If either party is required to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full 'reimbursement of all costs, including reasonable
attorneys' fees, from the other party The CITY may assign to persons impacted by the
performance ofthis Covenant the rigtlt to enforce thlsCovencmt against the OWNER.
