In consideration of the approval of a Building Permit to construct a 708-square-foot, detached guest house on the referenced property by the City of Poway ("CITY" hereinafter), OWNER hereby agrees that the ,detached guest house shall never be rented or leased as a separate unit, no complete' kitch.enfacilities shall be installed, and no gas line and/or 220 ampere electrical service shall ever be installed except for in the water heater area, and used solely for water heater purposes. This Covenant shall run"with the land and b~ binding upon and inure to the benefit of the future owners, encurnbrances, successors, heirs, personal representatives, transferees and assigns of the respective parties. In the event that Building. Permits are never obtained to construct the proposed detached guest house at the request of the OWNER, the CITY shall expunge this Covenant from the record title of the PROPERTY.
