COVENANT REGARDING REAL PROPERTY
Sandra C Grey, a widow, ,and Brad 0 Grey, a married man as his sole and separate
property ("OWNERS" hereinafter), ,are the owners of real property commonly known as
Assessor's Parcel Number 317"060"19 ("PROPERTY hereinafter), and more fully described as:
Lot 56 of poway Valley, City of Poway, ,County of San Diego, State of California,

according to Map thereof No. 3855, filed in the Office of the County Recorder of San Diego
County, April 2, 1959
In consideration of the approval of a Building Permit ,to construct a 495,square-foot,
detached guest house on the referenced property by the City of Poway ("CITY" hereinafter),

OWNER hereby agrees that the'detached guest house' shall never be rented or leased as a
separate unit, no complete ,kitchen facilities shall beinslalled, and no gas line and/or 220
ampere electrical service shall ever be installed, except in ihewater heater area and then used
solely for water' heater purposes.
This Covenant shall run with the land and be binding Upon and inure to the benefit of the
future own~rs, encu,mbrance:s, successors, heirs, personal representatives, transferees and
assigns of tne respective parties.
In the event that a Building Permit is never obtained to,:construct the proposed detached
guest house at the 'request of'the OWNER, the CITY shall expunge this Covenant from the
record title of the PROPERTY
If ,either party ,is required to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be e[ljitled to 'full reimbursement of all costs, including reasonable
attorneys' 'fees, from the other party The CITY may assign to persons impacted by the
perform~nce of this Covenanrthe right to enforce this Covenant againsfthe OWNERS.
