Caleb & Karla M. Nq (hereinafter"GRp.NTOR") hereby grants to CITY OF POWAY, (hereinafter
"GRANTEE"), its successors, or assigns express permission to construct a concrete masonry
sound wall along the westerly edge ofthe subject property line, at or along the alignment of the
existing chain link fence, as well as, the Temporal)' COr:1struction Easement and incidents
thereto for construction of a 'sound wall across that certain real property in the City of Poway,
County of San Diego, State of California.
From the Westerly Property Line to the Easterly Top of the Drainage Culvert
The GRANTOR, hereby further grants to the City of Poway the privilege and right to extend
excavation and embankment .sLopes within the limits of the .herein described Temporary
Construction Easement, where required for the construction and maintenance of said sound
wall.
The GRANTOR, for him/hers,elf; hi~/her successors and assigns, hereby waives any claim for
ar:1Y and all severance damages to GRANTOR's remaining property contiguous to the
Temporary Construction Eas~rTl~r\t, hereby conveyed by reason of the location, construction,
landscaping, or maintenance of said easement.
The GRANTOR hereby further grants to GRANTEE the right to temRorarily enter and construct
necessary re"lated'improvements as' part ofihe:proposeii\:onstrutiioh process This Temporary
Constrliction Easemeht; 'as descrioecj" 'snail be valid only untiL the construCtion has beer:1
accepted by the GRANTEE. After sucn time, the Temporary Construction Easement shall
