Bert & Teresa Crossman (hereinafter "GRANTOR") hereby grants to CITY OF POWAY,
(hereinafter "GRANTEE"), its successors, or assigns express permission to construct a
concrete masonry sound wall ~along tDe westerly edge of.th\l subject property line, at or along
the alignment of the existir:1g chain link fence, as well as, the Temporary Construction Easement
and incidents thereto for constr.uction of a sound wall across that certain real property in the
City of Poway, County of San Diego, State of California.
From the Westerly Property Line to the Easterly Topcof the Drainage Culvert
The GRANTOR, hereby fur:ther .gr~nts to the City of PoWay the privilege and right to extend
excavation and embankment slopes within the limits ,of the herein described Temporary
Construction Easement, where required for the construction and maintenance of said sound
wall.
The GRANTOR, for him/herself, his/her successors,.ahd assigns, hereby waives any claim for
any and all severance damages to GRANTOR's remaining property contiguous to the
Temporary Construction Easemehthereby conveyed by reason of the location, construction,
landscaping, or maintenance of s.aiCfeasement.
The GRANTOR hereby further gr'arlts to GRANTEEctheriaht to temporarily enter and construct
necessary,:related impr.()vements,as part:ofth~ propo:,;ed construc;tion process. This Temporary
ConstrUCtion Easement, as' described, sh'all be valid" only until the 'construction has been
accepted by the GRANTEE. After such time. the Temporary Construction Easement shall
become. null and void.
