(hereinafter "GRANTEE"), its i;'uccessors', or assigns, the Temporary Construction, Easement
and incidents thereto for construction ,of a screen wall across that certain real property in the

The GRANTOR, hereby further 'grants to the City of Powaytheprivilege and right to extend
excavation and embankment slopes within the limits ,of the. tlerein 'described Temporary
Construction Easement,whererequired for the construction. of said screen wall.
The GRANTOR,for him/herself, his/her successors and assigns, hereby waives any claim for
any and all severance damages to GRANTOR's' remaJlling property contiguous to the
Temporary Construction Easement. Said severance damage relates ,to the market value of the
home.
The GRANTOR hereby further grarits to GRANTEE the right to temporarily enter and construct
necessary related improvements as part of the proposed, construction process. The GRANTEE
accepts liability for the construdioli,.activity therein. This Temporary Construction Easemenl, as
described, shall be valid only'untilthe construction has been accepted bY the GRANTEE. After
