FOR SCREEN WALL (AUBREY PARK - CIP PROJECT #5657)

James &, Brenda Leal (hereinafter "GRANTOR") hereby grants to CITY OF ,P0WA'!,
(hereinafter "GRANTEE"), its successors, or assigns, the Temporary Construction, Easement
and incidents thereto for construction of a screen wall across, that certain real property in the
City of Poway, County of San Diego, State of California, described as follows:
(The Easterly 5 Feet of APN No. 314-182q9)
The GRANTOR, hereby further ,grants to the City of Poway the privilege and right to extend
excavation and emban~ment slop~s within the limits of the herein described Temporary
Construction Easement, where,required for the construction of said screen wall.
The GRANTOR, for him/herself, his/her successors and assigns, hereby waives any claim for
any and all severance damages to GRANTOR's remaining property contiguous to the
Temporary Construction Easement. Said severance damage relates to the market value of the
home
The GRANTOR hereby further'grantsto GRANTEE the right 10 temporarily enter and construct
necessary related improvements'as part of the proposed construction process. The GRANTEE

accepts liability for the construction;activity therein. This Temporary Construction Easement, as
described, shall be valid cinly'lihtil;the construction has been accepted by the GRANTEE. After
such time,Jhe Temporary Construction Easement.shall become null and void.
