RESOLUTION NO 04-078
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
GRANTING AN EASEMENT FOR THE MAINTENANCE AND
OPERATION OF THE MADERAS GOLF COURSE
TO THE MADERAS COUNTRY CLUB, LLC, ITS SUCCESSORS AND ASSIGNS,
OVER A PORTION OF THE PROPERTY IDENTIFIED AS APN' 277-170-10
WHEREAS, Maderas Country Club, LLC, has requested that the City of Poway
grant an easement for the operation and maintenance of the Maderas Golf Course over
a portion of Lot D of Map No. 13708, APN 277-170-10, and
WHEREAS, the requested 0 08-acre easement has been incorporated into the
design of the Maderas Golf Course, and
WHEREAS, the proposed easement will secure access rights for the Maderas
Country Club, LLC, across the City easement, that the requested easement does not
additionally burden the City's land, and the Maderas Golf Course will maintain the
requested easement section.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
1 The easement for the operation and maintenance of the Maderas Golf
Course to the Maderas Country Club, LLC, its Successors and Assigns,
shall be made appurtenant only to the property described in Exhibit "A"
and depicted in Exhibit "B"
2. The City Clerk of the City of Poway is hereby directed to cause a certified
copy of this Resolution to be recorded in the office of the San Diego
County Recorder
PASSED, ADOPTED, AND APPROVED, by the City Council of the City of
Poway, California, at a regular meeting this 7th day of September 2004
