of CaUforniq, according to Map thereof No. 12429, filed in the Office of the County'Recorder of
San Diego County on July 28, 19'89
III consideration of the approval of a Building Permit to construct a. 486~square-foot,
detached pool house on the referenced. property by 'the City of Poway ("CITY" hereinafter),
OWNER hereby agrees ,that the detached' pool:tioi'ise shall 'never be reritedor leasea as a
separate' 'uriit, . nocomprete kitchenfacilitiessharr~be-instarrecVand no-gas-'nne and/or 220'- -, --' ~
ampere,electrital service shall ever be installed, except in the walE;r heater area and then used

This Covenanlshall run with the land and be, binding upowand inure,to the benefit of'the

assigns of the respective parties.
In the event that a Building' Permit is never obtained to construct the proposed detached
pool house at the request of tneOWNER, the CITY shall expunge this Covenant from the
record title of the PROPERTY
If either party is required to incur costs to eriforcE) the provisions of this Covenant, the "
