GRANT OF TEMPORARY CONSTRUCTION EASEMENT
FOR THE COMMUNITY ROAD IMPROVEMENT PROJECT, PHASE 2
Rornuto F Puertollano, a married man, and Aurora J Puertollano, a married woman
hereby grant to the CITY OF POW A Y, (hereinafter "Grantee"), its successors, or assigns,
a Temporary Construction Easement and incidents thereto for construction of the Community Road Improvement Project.
Phase 2, across that certain real property in the City of Poway, County of San Diego, State of California, described as
follows:
A ten (10,00) foot wide strip of land lying contiguous to and Easterly of a line as described in the attached Exhibit
"A" and as shown graphically on Exhibit "B" for clarity only
The GRANTORS hereby further grant to the City of Poway the privilege and right to perforrn construction activities within
the limits of the herein described Temporary Construction Easement, where required for the construction of said
improvements,
The GRANTORS. for themselves, successors and assigns, hereby waive any claim for any and all severance damages to
GRANTORS' remaining property contiguous to the Temporary Construction Easement. Said severance damage relates to
the market value of the home (residence).
The GRANTORS hereby further grant to GRANTEE the right to temporarily enter and construct necessary and related
improvements as part of the proposed construction process. The GRANTEE accepts liability for the construction activity
therein, The Temporary Construction Easement, as described herein, shall be valid only until the construction has been
accepted by the GRANTEE or for a period of one year from the recording date of this document, whichever event occurs
first. Upon said termination, the GRANTEE shall have no further rights or liability in connection with said temporary
construction easement.
