Wetzel, husband and wife as joint tenants ("OWNERS" hereinafter), are the owners of real property commonly known as Assessor's Parcel Number 275- 796-03 ("PROPERTY hereinafter), and rnore fully described as: Lot 34 of City of Poway Tract [\/0. 4093-R, in the City of Poway, County of San Diego, State of California, according to Map thereof No. 11396, filed in the Office of the County Recorder of said county, December 19,1985 In consideration of the approval of a Building Permit to construct a 600-squarecfoot, detached guest house and a 1,000-square-foot garage/workshop, totaling 1.600 square feet, on the referenced property by the City of poway ("CITY" hereinafter); OWNER hereby agrees that the detached guest house shall never be rented or leased as a separate unit, no complete kitchen facilities shall be installed, and no gas line and/or 220 ampere electrical service shall ever be installed except for in the water heater area, and used solely for water heater purposes, and that the detached garage/workshop is non_habitable space. This Covenant shall run with the land and be binding upon and inure to the benefit of the future owners, encumbrance's,' successors, heirs, personal representatives, transferees and assigns of the respective parties.
