COVENANT REGARDING REAL PROPERTY
Theodore Philip ,Barlam and Andrea Vallez-Barlarn, PH.D., husband and wife as Joint
Tenants, ("OWNERS" hereinafter), are the owners of real property commonly known as
Assessor's Parcel Number 314.701-28 ("PROPERTY hereinafter), and more fully described as:
Lot 123 of Poway Tract No. 3495; in the City of Poway, County of San Diego, State of
California, according to Map thereof No. 9981, filed in the Office of the County Recorder of San
Diego County, on January 27, 1981
In consideration of the approval of a Building Permit to construct a 375-square-foot guest
suite on the referenced property by the City of poway ("CITY" hereinafter), OWNERS hereby
agree that the guest suite shall never be rented or leased as.a separate unit, no kitchen facilities
shall be installed and no gas line and/or 220 amperes electrical service shall ever be installed.
This Covenant shall run witntne land and 'be binding upon and inu-re to thebenefit of The ----
future owners, encumbrancers, successors, heirs, personal representatives, transferees and
assigns of the respective parties.
In the event that Building Permits are never obtained to construct the proposed guest
suite at the request of the OWNERS, the CITY shall expunge this Covenant from the record title
of the PROPERTY
If either party is required to ,incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to f!J1I reimbursement of all costs, including reasonable
attorneys' fees, from the other 'party The CITY may assign to persons .impacted by the
performance of this Covenant the right to enforce this Covenant against OWNERS.
