COVENANT REGARDING REAL PROPERTY
Michael K. Spartz and Qanielle' M. Spartz, husband and wife as community property with
right of survivorship ("OWNERS" hereinafter), are the owners 01 real property comrnonly known
as Assessor's Parcel Number 320"212-04 ("PROPERTY hereinafter), and more fully described
as:
Lot 107 of City olPoway TractNo. 88-04R Unit,No. 2, in the City of Poway, County of
San Diego, State of California, according to Map thereof No. 13542, filed in the Office of the
County Recorder of San Diego County, March 17, 1 S98.
In consideration of thea~proval of a Building PE;rmit to construct a 460-square-foot,
detached pool house on the. referenced property by the City of Poway ("CiTY" hereinafter),
OWNER hereby agrees that the detached pool house shall never be rented or leased as a
separate unit, no complete kitchen facilities shall be in,stalled, and no gas line and/or 220
ampere eleclrical service shall ever be installed except for in the water heater area, and used
solely for water heater, purposes.
This Covenant shall run with the land and be binding .upon and inure to the benefit of the
future owners, enc~mbrance's, suc;cessors, heirs, personal representatives; transferees and
assigns of the respective parties.
In the.event that a BuildilJgJ'ermit is never obtained'to construct the proposed detached
pool house at the request of the OWNER, the CITY shall expunge this Covenant from the
record title ofthePROPERTY
If either party is required to incur costs to enforce the provisions ofthis Covenant, the
p-revailing party shall be entitled t() full reimb)JrsE'!ment of all costs, including reasonable
attorneys' fees; from the other party The CITY may assign to persons impacted by the
performance of this Covenant the right to enforce this Covenant against the OWNERS.
