In consideration of thea~proval of a Building PE;rmit to construct a 460-square-foot, detached pool house on the. referenced property by the City of Poway ("CiTY" hereinafter), OWNER hereby agrees that the detached pool house shall never be rented or leased as a separate unit, no complete kitchen facilities shall be in,stalled, and no gas line and/or 220 ampere eleclrical service shall ever be installed except for in the water heater area, and used solely for water heater, purposes. This Covenant shall run with the land and be binding .upon and inure to the benefit of the future owners, enc~mbrance's, suc;cessors, heirs, personal representatives; transferees and assigns of the respective parties. In the.event that a BuildilJgJ'ermit is never obtained'to construct the proposed detached pool house at the request of the OWNER, the CITY shall expunge this Covenant from the record title ofthePROPERTY If either party is required to incur costs to enforce the provisions ofthis Covenant, the p-revailing party shall be entitled t() full reimb)JrsE'!ment of all costs, including reasonable attorneys' fees; from the other party The CITY may assign to persons impacted by the performance of this Covenant the right to enforce this Covenant against the OWNERS.
