OWNER hereby agrees to the foliowing:

This Covenant shei!l rimY/ith the land and be binding upon and inure to the benefit of the future
owners, encumbrances, successors, heirs, persOnal representatiiies, transferees and assigns of the

In the event that Minor Development Review Application 02,65' expires or is rescinded by City
Council, CITY shall at the request of OWNER expunge this Covenant from the record title of PROPERTY

entitled to full reimbursement of all costs, including reasonableatlorneys' fees, from the other party
